POPI Act Implementation
- This contract will be applicable to all personal information as defined in the Protection of Personal Information Act, 4 of 2013 (“POPI”).
- By either Party submitting any personal information to the other, the disclosing Party unconditionally and voluntarily, consents to the processing of the submitted personal information for any and all purposes related to this agreement which includes the sharing of photos on social media and the use of photos for Pepper Tree marketing material.
- Clients have the choice to refuse the use of any personal media and photos of their event at Pepper Tree. If this is the case, please notify us in writing.
- Pepper Tree shall at all times comply with its obligations and procedures under the POPI Act which includes the safekeeping of all personal information.
- Pepper Tree shall not process, disclose or use personal information except for the use of marketing on our social media platforms unless otherwise expressly authorised by the other party in writing.
- Pepper Tree shall not disclose any personal information to any Third Party without the other Party’s prior written consent in each instance.
Indemnity
- Guests enter the property at their own risk and waive any and all claims of any nature, against Pepper Tree, its employees, representatives and any member thereof in regard to any and all damages and/or loss that patrons or their invited guests may suffer as a consequence of any act therefore relative to the safeguarding and securing of the facilities available within Pepper Tree, including but not limited to the use of any property situated within the boundaries of the venue.
- Guests hereby indemnify Pepper Tree and all Members thereof against any claim which may be made against Pepper Tree or any Member thereof by any of their family, friends, guests or invitees visiting or attending the facility who may sustain any loss or damage whilst utilizing any property situated within Pepper Tree irrespective of any act or omission by Pepper Tree or any Member thereof relative to the facilities.
- Guests confirm that this indemnity shall in all aspects be binding upon their Executor, Heirs, Assigns, Children, and Dependents, Spouse, Relatives and any person who might derive a right to claim in respect of any of the matters herein contained.
